The European Union has taken a strong stance on artificial intelligence by banning certain AI systems deemed to pose significant risks to fundamental rights, security, and democracy. With the adoption of the EU AI Act, these prohibitions aim to ensure responsible AI development and prevent potential misuse. Here are the eight types of AI systems that are now banned within the EU.

1. Social Scoring Systems

Inspired by China’s social credit system, AI-driven social scoring evaluates individuals based on their behavior, often leading to discrimination and undue restrictions on freedoms. The EU has banned such systems to prevent unjust societal stratification.

2. AI-Based Predictive Policing

AI systems designed to predict crimes before they happen, based on profiling and past data, are prohibited due to concerns over bias, privacy violations, and the potential for wrongful accusations.

3. Emotion Recognition in Workplaces and Schools

AI tools that analyze facial expressions, voice tones, or other biometric indicators to determine emotions in sensitive environments like workplaces and schools have been banned due to ethical concerns and the potential for misuse.

4. Indiscriminate Biometric Surveillance

The use of AI-driven facial recognition and other biometric identification systems in public spaces for mass surveillance purposes is no longer allowed, except under strictly defined circumstances such as national security investigations.

5. Manipulative AI Systems

AI systems designed to exploit human vulnerabilities—such as those that manipulate behavior, deceive users, or induce harmful decisions—have been banned to protect consumers and uphold ethical AI use.

6. AI That Exploits Vulnerable Populations

Any AI system specifically designed to take advantage of individuals in vulnerable situations, including children, elderly individuals, or people with disabilities, has been prohibited.

7. Subliminal AI Influence

AI technologies that subtly manipulate human behavior without the user's awareness—such as subliminal advertising techniques—are considered a serious threat to autonomy and decision-making and are now illegal in the EU.

8. Untested High-Risk AI Systems

AI systems that pose significant risks but have not undergone proper testing, transparency assessments, or regulatory approval are banned to ensure accountability and prevent potential harm.

Implications of the Ban

The ban reflects the EU's commitment to ethical AI development and upholding human rights. Companies operating within the EU must now ensure compliance with these regulations to avoid legal consequences and maintain consumer trust. The AI Act sets a precedent for global AI governance, influencing other regions to consider similar regulatory frameworks.

As AI continues to evolve, regulatory bodies worldwide will likely follow the EU’s example in establishing responsible AI guidelines that balance innovation with ethical considerations.
